Renewing a Malta Nomad Permit — and What Happens After Year Four

Malta’s Nomad Residence Permit runs for one year and can be renewed three times, but renewal is not automatic. You have to show you have actually lived in Malta for at least five months of the previous twelve, and from the second renewal you also file a tax-compliance declaration. After four years the permit ends, and official guidance is clear that it leads to no permanent residence.

How renewal works

The permit is "valid for one (1) year from the issuance of the residency card". The Residency Malta Agency (RMA) says it "may be renewed three times, for a total stay of a maximum of four (4) years". Each renewal is at RMA’s discretion. You apply through the same online portal used for the first application, and RMA advises applying two to three months before the current permit expires.

Two things end a renewal before it starts: overstaying, and missing the residence test below. RMA states that applicants who have overstayed are refused. Renewal is also the one point where you can add family members you did not include originally — after payment or approval of the first application, dependants cannot be added until renewal (newborns are the exception).

The five-months-in-Malta rule

To renew, you must prove at least five cumulative months of residence in Malta in the previous 12 months. "Cumulative" means the months do not have to be consecutive, but they do have to add up. This is the rule that catches people who treat the permit as an EU base while spending most of the year elsewhere — including back in the UAE.

The evidence RMA names is specific: "a bank statement showing payment transactions carried out in Malta". In other words, the proof is your spending pattern, not a declaration. If your day-to-day payments run through a card or account that does not show where the transaction took place, or you pay mostly in cash, your statement may not show the presence you actually had.

Planning for the residence test

  • Keep a running record of your days in Malta: the test looks at the 12 months before you renew, so a short final stretch cannot make up for a thin year.
  • Use a bank account whose statements show where each payment was made, and use it for everyday spending while you are in Malta.
  • Keep in mind that Schengen travel (up to 90 days in any 180) is allowed, but time spent outside Malta does not count towards the five months.
  • Download the bank’s own official statements in good time; RMA’s rules for the first application reject anything other than bank-issued PDFs.

The tax-compliance declaration at the second and third renewals

The first renewal turns on the residence test. The second and third renewals also need a tax-compliance declaration. RMA’s checklist calls it the "Local Practitioner Tax Declaration", and the form is downloaded from the portal. The name suggests a local tax practitioner is involved, so plan to have a tax adviser in Malta well before your second renewal is due, not the week before you file.

What Malta’s 10% tax rule actually says

Malta’s Nomad Residence Permits (Income Tax) Rules, S.L. 123.210 (Legal Notice 277 of 2023), set out how the main applicant’s income from authorised work is treated. As the rules state it:

  • That income is taxed at 10%, subject to double-taxation relief.
  • It is not taxed before the end of 12 months from the permit’s issue (or from 1 January 2024, if later), unless the holder files a declaration that their residence in Malta is "not merely of a casual nature".
  • If the holder proves foreign tax of at least 10% on that income, they need not report it in Malta.
  • Dependants’ income falls outside these rules.
  • Employment income under the permit is outside Malta’s Final Settlement System (its PAYE withholding).

What happens after four years

Four years is the maximum total stay. RMA’s FAQ is direct: "No, the Nomad Residence Permit does not lead to any sort of permanent/long-term residency or citizenship." It is separate from the Malta Permanent Residence Programme, and RMA’s FAQ does not describe time on the nomad permit as counting towards another status.

What RMA does say is that only one status can be held at a time. If you qualify for and move to a different Maltese permit, you must notify RMA so that the nomad permit is revoked. Any such move is a fresh application under that other permit’s own rules. RMA publishes no route that converts the nomad permit into one.

So the honest planning question is what comes after year four. If the answer is "settle in the EU", it is worth checking from the start whether another route offers a path to longer-term residence — for example, compare Portugal’s D7 and D8 and check their own rules — rather than finding out at the end of a four-year stay.

Common questions about renewing

Is renewal guaranteed if I meet the requirements? No. RMA describes renewal as discretionary, and grants of the permit are always discretionary.

Can I spend most of the year in the UAE and still renew? Only if you still reach five cumulative months in Malta within the previous 12, and your bank statements show it.

Can my spouse work locally once we have renewed? No. RMA’s work bar covers holders and their dependants for as long as they hold the permit.

Can I apply for a fifth year? No. Three renewals and four years in total is the published maximum.
